====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 12-03-2024 Heard Mr. Tribhuwan Narayan, learned counsel appearing on behalf of the petitioner and Mr. Amitesh Kumar, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Kudra P.S. Case No. 430 of 2023 registered for the offence punishable under Sections 341, 323, 379, 504 and 325/34 of the Indian Penal Code.

3. As per the allegation made in the F.I.R., the informant is the Headmaster of the school situated in the village of the accused persons who had assaulted him and had also snatched cash of Rs.25000/- from his bag.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is a student and he may

Learned counsel submitted that petitioner has undertaken to file written apology by way of affidavit in the District Court for any act of misbehaviour on his part.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

Considering the nature of allegation and the conduct of the petitioner that he has now realized that he should not indulge in such illegal act to harass the Headmaster of the school and in this regard he has also undertaken to file written apology by way of affidavit, in such circumstances, if such affidavit is filed by the petitioner, the District Court after accepting the affidavit filed by the petitioner is directed to release the petitioner, above named, on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Kaimur at Bhabua in connection with Kudra P.S. Case No. 430 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

7. The court below is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been stated in Para3 of the bail petition, this order will automatically lose its force. (Purnendu Singh, J) mantreshwar/- U T
