JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2019 Petitioners seek bail in anticipation of their arrest in connection with Harnaut P.S. Case No. 326 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307 and 504 of the Indian Penal Code, including Section 27 of the Arms Act.

Allegation against the petitioner No.3 is of order-giver and allegation against petitioner No.2 is that he thrashed the wife of the informant on the ground and petitioner No.2 is named in the FIR.

Submission of learned counsel for the petitioners is that the main allegation of firing is against co-accused Kapil Yadav and there is no allegation against petitioner No.2 and the allegation against petitioner No.1 is false and concocted.

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Harnaut P.S. Case No. 326 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
