The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 186, 447, 341, 323, 325, 307, 332, 333, 337, 338, 353, 380, 427, 435, 436, 506, 120(B) of the Indian Penal Code and sections 3⁄4 of the Damage to Pubic Property Act and Section 146, 147, 151, 153, 174 of the Railway Act and Section 27 of the Arms Act. As per allegation in the FIR, a protest was made by the student of Bihar against the Central Government Scheme Fireman as a result of which due to pelting stones, huge loss occurred to the government properties.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is

Patna High Court CR. MISC. No.11740 of 2023(2) dt.22-03-2023 2/2 simply a victim of false implication in this case due to high handedness of police. All accused persons have been attributed with general and omnibus allegations. Petitioner is languishing in judicial custody since 28.06.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge -XI, Patna in connection with ST No. 1063 of 2022 arising out of Rail P.S. Jehanabad (Taregna) Case No. 66/2022.
