JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 This application, for grant of anticipatory bail, arises out of Bahadurpur P.S. Case No. 183/18, disclosing offences under Sections 302/34 of the Indian Penal Code. Allegation as per F.I.R is that room mate of son of the informant informed the informant that his son has received fire arm injury and has been admitted in PMCH, on which, he went there and his son disclosed to the police that he was shot by Golu and 6 -7 persons were with him.

Submission of learned counsel for the petitioners is that save and except the disclosure made by Harsh Raj @ Golu with regard to involvement of the petitioners, there is absolutely

No.11787 of 2019(3) dt.29-04-2019 2/2 nothing against these petitioner and they have falsely been roped in the present case and considering the same, this court vide order dated 03.04.2019 passed in Cr. Misc. No. 7053 of 2019 has granted the privilege of pre arrest bail to one of the coaccused, namely, Kundan Kumar @ Kundan Kumar Singh. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-II, Patna City, in connection with Bahadurpur P.S. Case No. 183/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
