In this case, the petitioners are seeking anticipatory bail in connection with Bikramganj P.S. Case No. 417 of 2018 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act, 2016 and sections 272 and 273 of the Indian Penal Code.

The Police on secret information raided the house of one Badri Sah where the petitioner is a tenant and the father of these petitioners has disclosed that Guddu Kumar and Bigan used to bring the liquor from Uttar Pradesh and these petitioners used to sell the same. Guddu Kumar has already been granted

Patna High Court Cr.Misc. No.10062 of 2019(2) dt.20-02-2019 2/2 bail by one of the coordinate Bench of this Court in Cr. Misc. No. 3860 of 2019, but in the present case the petitioner is staying in the same house from where the liquor has been recovered.

In such view of the matte, this Court is not inclined to grant bail to the petitioners and accordingly their prayer for bail is rejected. However, if the petitioners surrender and pray for regular bail within three weeks, the court below will be obliged to pass an order in accordance with law without being prejudiced by this order.
