JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State through video conferencing in view of the total lock-down on account of COVID-19 pandemic.

In this case, the petitioner is seeking regular bail in connection with Teghra P.S. Case No.356 of 2018 registered for offence punishable under section 30 (a) (b) of the Bihar Prohibition and Excise (Amendment) Act.

As per the record, on secret information, a raid was conducted and the police recovered 43 cartoons of liquor from a truck and two persons including this petitioner have been arrested.

Learned counsel for the petitioner submits that the petitioner is the driver of the aforesaid truck, who has moved earlier before this Court for regular bail in Cr. Misc. No. 27444

Patna High Court CR. MISC. No.12481 of 2020(3) dt.13-05-2020 2/2 of 2019, which has been dismissed for default. He further submits that the petitioner is in custody for about one year and seven months.

Considering the aforesaid facts as well as the period of custody, the petitioner, named above, is directed to be released on bail on his personal bond to the satisfaction of 2nd Additional Sessions Judge-cum- Special Judge, Excise Act, Begusarai, in connection with Teghra P.S. Case No.356 of 2018, subject to the condition that if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to file an application for cancellation of his bail bond.
