2. The petitioner has prayed for bail in connection with Uchakagaon P.S. Case No. 403 of 2025 registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109(1), 352 and 3(5) of B.N.S.

3. The case of the prosecution, in short, is that one Ritesh has assaulted with knife to Tuntun Chaurasiya. It is further alleged that when the informant went to rescue, Ritesh, the petitioner and one Dhanu Kumar have assaulted with knife to the informant, Ankit Kmar and Suraj Kumar.

Patna High Court CR. MISC. No.9674 of 2026(4) dt.08-04-2026 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has further been submitted that main thrust of allegation is against Ritesh and the injuries of Tuntun Chaurasiya were found to be grievous in nature. However, the nature of allegation against the petitioner is general and omnibus. It is not clear as to whom he has assaulted. The injury report of the three victims, namely, Sintu, Ankit and Suraj goes to show that they have received simple injury caused by sharp cutting weapon. It has further been submitted that the allegation against the petitioner is that of general and omnibus nature and moreover, the injuries are simple. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 10.11.2025.

5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M.,
