Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Shyampur Bhataha P.S. Case No. 71 of 2022 dated 08.04.2022 lodged under Sections 394 / 34 of the I.P.C.
As per the prosecution case, the present F.I.R. has been lodged under Sections 394/ 34 of the I.P.C. for snatching of motorcycle and cash.
Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Counsel submits that the case in which petitioner was made accused, has already been closed and he has been acquitted. He further
Patna High Court CR. MISC. No.8977 of 2023(2) dt.03-05-2023 2/2 submits that petitioner is in custody since 11.04.2022. Learned counsel for the State opposes the prayer for bail and submits that from record, it transpires that the case is relating to dispute of money between the parties. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Sheohar in connection with Shyampur Bhataha P.S. Case No. 71 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
