Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 409 and 420(B) of the Indian Penal Code, registered in connection with Sherghati P.S.Case No. 514 of 2020.

As per allegation, the then Branch Manager, Magadh Central Co-operative Bank Ltd. and the present petitioner, who was the cashier, in collusion with PACS Chairman Ajit Paswan facilitated loan of Rs. 10,07,500/- after producing forged Kisan Credit Card of 31 farmers. The learned counsel for the petitioner has submitted that the petitioner is cashier and he is not authorized to sanction the loan. Only Branch Manager is authorized to sanction the

Patna High Court CR. MISC. No.9114 of 2022(2) dt.05-09-2022 2/2 loan and the Branch Manager has been granted anticipatory bail by a coordinate Bench of this Court in Cr.Misc. No. 17856 of 2021 under order dated 24.07.2021, on the ground that he has joined in that Branch after the occurrence has taken place. Considering the above facts and circumstances as well as the clean antecedent of the petitioner, let him, above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Gaya in connection with Sherghati P.S.Case No. 514 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
