====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Special Case No. 6163 of 2019 arising out of Masaurhi P.S. Case No. 528 of 2019 for the offenses under Sections 30(a), 30(d) and 37(c) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 80 ltrs of country made mahua was recovered. The petitioner is in custody since 19.11.2019.

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on

Patna High Court CR. MISC. No.6985 of 2020(2) dt.04-02-2020 2/2 furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Patna, in connection with Special Case No. 6163 of 2019 arising out of Masaurhi P.S. Case No. 528 of 2019. However, in the event the petitioner is found involved in the similar cases in future, the court below shall be at liberty to cancel his bail bonds in the present case.
