JUSTICE AMARESH KUMAR LAL ORAL ORDER 17-03-2015 Heard learned counsel for the petitioners and the State. Petitioners seek bail in a case registered for offences under Sections 304 (B), 201/34 of the Indian Penal Code. The allegation against the accused including the petitioners is to have demanded motorcycle, ornaments and cash and due to non fulfillment of demand of dowry, the deceased has been caused to death and the dead body had been disposed of. It has been submitted that the petitioners are father-inlaw and mother-in-law of the deceased. There is no specific allegation of overt act against them. Prior to the occurrence, there was some altercation between the deceased and her husband. The husband of the deceased is already in custody since 24.06.2014 and the petitioner have no criminal antecedents. After investigation, charge sheet has already been submitted and there is

Considering the facts and circumstances, the above named petitioners shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari (East Champaran) / court concerned in connection with Chhatauni P.S.Case No. 72 of 2014 after framing of charge with following conditions:- I) One of the bailors will be the close relative of the petitioners.

II) The petitioners will not indulge in similar or in any other offence.

III) The petitioners will be well represented in the Court.

IV) In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the Court concerned.
