JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Lauriya P.S. Case No. 153 of 2019 registered for the offence punishable under Sections 342, 323, 325, 307, 504, 34 of the Indian Penal Code and Section 27 of the Arms Act. Prosecution case is that, informant went to the house of the petitioner to demand his money of Rs. 80,000/- and there was some altercation with the son of the petitioner was made out. So far petitioner is concerned, he fired on the informant causing injury on his shoulder.

Submission of the learned counsel for the petitioner is that as a matter of fact there was an altercation between both the parties and this case has been filed as a counter blast case to save their skin. Counsel for the petitioner further submits that the injury report shows that injury is not dangerous for life.

Patna High Court CR. MISC. No.8088 of 2020(2) dt.20-02-2020 2/2 Heard learned A.P.P. also who has opposed the prayer for bail on the ground that injury is grievous in nature and the injury which is caused by the petitioner is still dangerous for life.

Having heard both sides, in view of the allegations, as submission made above and petitioner is in custody for about five months, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bettiah, West Champaran, in connection with Lauriya P. S. Case No. 153 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
