JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 14-08-2019 In view of an efficacious remedy available to the petitioner under the Redressal of Public Grievances Rules, 1998 (hereinafter referred to as the 'Rules of 1998') by filing a complaint before the Insurance Ombudsman, learned counsel for the petitioner submits that he may be granted liberty to file a complaint before the Insurance Ombudsman within a period of 30 days for redressal of his grievance. It is submitted that earlier a complaint vide Annexure '7' dated 14.10.2017 had been

Learned counsel for the Insurance Company has no objection to the same.

This writ application is, thus, disposed off with liberty to the petitioner to pursue Annexure '7' dated 14.10.2017 said to have been filed with the Insurance Ombudsman and in the process if so required the petitioner may file a duly constituted complaint petition before the Ombudsman within a period of 30 days from today. The Insurance Ombudsman shall consider the complaint in accordance with Rule 15 and 16 of the Rules of 1998 after giving an opportunity of hearing to all concerned. Such complaint may be disposed off as expeditiously as possible within the statutory period.
