JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks bail in connection with Narpatganj (Basmatiya) P.S. Case No.281 of 2019, registered under Sections 302/120B/34 of the Indian Penal Code. The allegation against the petitioner is that the petitioner, along with 66 other accused persons assaulted the father and brother of the informant due to which they sustained injury and died.

Submission of learned counsel for the petitioner is that the petitioner is innocent and has falsely been implicated in this case by the informant mere on account of previous enmity. Considering the same, several other accused persons have been granted anticipatory bail as well as bail vide order dated 16.07.2019, 15.07.2019, 16.11.2019, 30.09.2019, 17.10.2019,

Patna High Court CR. MISC. No.7211 of 2020(2) dt.24-02-2020 2/2 17.01.2020 passed in Cr. Misc. No. 43593 of 2019, 42249 of 2019, 50654 of 2019, 51154 of 2019, 62137 of 2019, 62005 of 2019 and 72118 of 2019 respectively.

Learned counsel for the State as well as learned counsel for the informant oppose the prayer for bail. They submitted that the petitioner was also accused in one more case. It is further submitted that the petitioner has threatened the informant to withdraw the case lodged against him. In view of the above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj (Basmatiya) P.S. Case No.281 of 2019.
