JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2019 This application, for grant of anticipatory bail, arises out of Manjhagarh P.S. Case No. 356 of 2018, disclosing offences under Sections 341, 447, 323, 324, 307/34 of the Indian Penal Code.
Allegation against the petitioners and co-accused persons is of assault to the informant causing injury to him and specific allegation against co-accused Sunil Sah of inflicting knife blow to the informant.
Submission of learned counsel for the petitioners is that there is case and counter case between the parties and land dispute is admitted. Further, submission is that injury caused to the informant was found to be simple in nature, which is alleged to have been inflicted by sharp cutting weapon and

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Manjhagarh P.S. Case No. 356 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
