====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 307, 354, 379 and 506/34 of the Indian Penal Code.
3. As per prosecution case, on the alleged date and time of occurrence, while the informant was standing outside the house, co-accused Mukesh Kumar along with this petitioner, Gautam Tufan came on motorcycle and fired on him, but missed and thereafter, they assaulted with butt of pistol, causing injury on the head of informant and when wife of informant came to save him, she was also assaulted by this petitioner and mother of Gautam Tufan. It is further alleged that the accused persons
Patna High Court CR. MISC. No.9345 of 2025(3) dt.08-07-2025 2/3 snatched Mangalsutra of wife of informant and also took away cash of Rs. 5 lakhs from informant.
4. Learned counsel for the petitioner submits that informant is own step brother of petitioner and due to dispute relating to property, this false and concocted case has been lodged. The injury alleges sustained by the injured are simple in nature and there is no allegation of repetition of blow. There is delay of three days in instituting the F.I.R and there is no explanation for the same. Similarly situated co-accused Mukesh Kumar and Renu Devi have already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 08.08.2024 passed in Cr. Misc. No. 51212 of 2024 and order dated 02.04.2025 passed in Cr. Misc. No. 7923 of 2025 respectively.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Gaya in connection with
