Learned counsel for the petitioner submits that the father of the petitioner was a Panchayat Teacher and he died in harness on 19/07/2016. Petitioner applied for compassionate appointment but his application was rejected on the ground that she is not B.tet qualified.

Learned counsel for the State fairly submits that as per the Government policy, deponents of the deceased, in case of not

Patna High Court CWJC No.5993 of 2021(3) dt.16-07-2024 2/2 possessing eligibility criteria, shall be recruited against Class-III & Class-IV post as per their requisite qualification. 4.

Accordingly, this writ application is disposed of with a direction to the petitioner to file a representation before the respondent no.4/ District Education Officer, Vaishali, within a period of two weeks' along with a copy of this order and other documents in support of her claim. The respondent no.4 shall dispose of the representation of the petitioner within a period of ten weeks' after affording an opportunity of hearing to the petitioner and pass a speaking and reasoned order in the light of memo no.888 dated 27/08/2021.

It is made clear that the respondent no.4 shall be held responsible non-compliance of this order within the stipulated period.
