The petitioner seeks bail in a case registered under Section 394 of the Indian Penal Code and Section 25(1-B)a & 26 of the Arms Act.

It is submitted on behalf of the petitioner that in fact an accident took place with the motorcycle which the petitioner was allegedly riding with other co-accused persons. After the accident, petitioner was assaulted and this case has been lodged. It is further submitted that there is no recovery of any snatched money from the possession of the petitioner. Allegedly a revolver with cartridge was recovered from his possession. However,

Case No.45/2014 which has been lodged under Section 304 of the Indian Penal Code in which allegation was that when he was driving tractor one person fell from trailor and had died. Petitioner is stated to be in custody since 24.06.2014.

Having regard to the facts and the circumstances of the case, the petitioner, Bigu Chaudhary is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Bagaha, District, West Champaran in connection with Chautarwa (Bathwaria) P.S. Case No.147/2014.
