In this case, the petitioner is challenging the order dated 5.7.2016 passed by the District Magistrate, Madhubani in Supply Appeal Case No. 30 of 2016-17 by which the appeal, filed by the petitioner, has been dismissed on the ground of delay in filing the appeal.

In that view of the matter, the impugned order dated 5.7.2016 is quashed and the matter is remanded back to the Collector, Madhubani who will be obliged to condone the delay and decide the case on its merit.

With the aforementioned observation and direction, this
