JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-03-2018 Two second appeals arose out of the same judgment, dated 27.05.2015, passed by learned Additional District Judge VIII, Patna, in Title Appeal No. 1208 of 2014, including the present one, both preferred by the appellant. In this second appeal, the appellant is aggrieved by rejection of his Cross-Appeal No. 01 of 2016. The other second appeal, being Second Appeal No. 617 of 2017, against the same impugned judgment, dated 27.05.2017, passed by learned Additional District Judge VIII, Patna, whereby respondent's appeal had been allowed by the Court below has been dismissed by this Court, by judgment and order, dated 15.03.2018.
In view of the reasonings assigned in the said judgment, this appeal is also dismissed as in the Court's view, there is no
Patna High Court SA No.619 of 2017(3) dt.16-03-2018 2/2 substantial question of law, which the present second appeal, too, involves.
Learned Counsel appearing on behalf of the appellant, though, has submitted that admittedly, there was no documentary evidence to support the finding of existence of relationship of landlord and tenant nor payment of any rent. Be that as it may. In view of the judgment delivered in Second Appeal No. 617 of 2017, this appeal stands dismissed since all such aspects have been considered in the said judgment, dated 15.03.2018.
