JUSTICE GOPAL PRASAD ORAL ORDER 20-02-2015 Heard learned counsel for the petitioners and learned counsel for the State.

Two bail petitions are being heard together and disposed off by common order as two cases arise in connection with Awtarnagar P.S. Case No. 109 of 2014 registered under Sections 302, 120B and 307/34 of Indian Penal Code.

There is specific allegation against one of the co-accused Mahesh Rai armed with Carbine shot fired upon the Mritunjay Singh, by which he succumbed to injury.

Patna High Court Cr.Misc. No.48368 of 2014 (2) dt.20-02-2015 Learned counsel for the petitioners submits that there is no direct allegation against these petitioners. It is further submitted that names of co-accused Indal Rai and Satendra Rai does not find place in the First Information Report. Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Awtarnagar P.S. Case No. 109 of 2014.
