The petitioner seeks bail in a criminal prosecution registered under Section 302 of the Indian Penal Code. Taking into consideration the fact that the petitioner is alleged to have committed the crime of murder with respect to his own wife, namely, Hemanti Kumari, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of bail in connection with Mohania P.S. Case No. 277 of 2014, pending in the court of learned Chief Judicial Magistrate, Kaimur, Bhabhua, at this stage and it is accordingly rejected for the present.
Learned Chief Judicial Magistrate, Kaimur, Bhabhua is directed to commit the case of the petitioner to the court of sessions forthwith, if not already committed. On commitment of the case, the learned trial court shall take up the case of the petitioner on priority basis and all endeavours shall be made to conclude the trial within a period of one year from the date of framing of charge.
