The petitioner is languishing in custody since 12.07.2018 in a case registered for the offences punishable under Sections 379 and 411 of the IPC.
The prosecution case is that on 11.07.2018 the informant was standing in a queue in Sub-Divisional Hospital, Banmankhi for his treatment, then one unknown person stole away his wrist watch from his pocket. Thereafter, the petitioner while pickpocketing another person was caught by Home Guard constable deputed in the said hospital thereafter from his possession, the stolen wrist watch of the informant was recovered. It is submitted by learned counsel for the petitioner that the petitioner is in custody for more then six months. A statement
Patna High Court Cr.Misc. No.9302 of 2019(2) dt.18-02-2019 2/2 has been made in paragraph no.3 of the petition that the petitioner is involved in two other cases and he is on bail in those cases.
Learned APP submits that the petitioner was caught red handed and the recovery has been made from his possession. Considering the fact that investigation being concluded and the period under custody, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned CJM, Purnea in connection with Banmankhi P.S. Case No.133 of 2018.
