ANJANA MISHRA ORAL ORDER 26-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Darbhanga Mahila P.S. Case No.76 of 2014 for allegedly having committed the offence under Sections 448, 354, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the present case has been instituted against the petitioner only on account of personal vendetta as the petitioner's father had filed a complainant case, bearing C.R. No. 1066 of 2014, against the husband of the informant. It is further submitted that it is only on account of the said reason that the petitioner's name has been brought into the present case.

No.49086 of 2014 (4) dt.26-08-2015 2/2 Considering the nature of allegations made and that there was some dispute between the parties and also that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with Darbhanga Mahila P.S. Case No.76 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
