JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date: 18-05-2018 Learned counsel for the petitioners with reference to Annexure-3 submits that the issue raised in the present writ application is no more res integra.
2. A coordinate bench of this court has examined the issue and vide order contained in Annexure-1 i.e. order in C.W.J.C. No. 6139 of 2007 dated 31.3.2011 held out that on completion of 12 years of service, the petitioners are entitled to grant of senior scale of pay.
3. Considering the above, the writ petition is disposed of with direction to the District Education Officer, Rohtas to examine
Patna High Court CWJC No.9604 of 2018 dt.18-05-2018 3/3 the claim of the petitioners in the light of Annexure-1 and if it is found that the case of the petitioners is covered by the decision of this court in C.W.J.C. No. 6139 of 2007, necessary order may be passed by the respondents granting similar benefit to the petitioners.
4. The entire exercise in this regard must be completed within a period of sixty days from the date of receipt/production of a copy of this order.
5. With the aforesaid, the writ petition stands disposed of.
