The petitioner apprehends his arrest in Harsidhi P.S. Case No. 454 of 2021, registered for the offences punishable under Section 395 of the Indian Penal Code.

As per the prosecution case, the accused persons looted the truck of the informant, loaded with articles and threw the driver by the side of road.

It is submitted that petitioner is not named in the FIR. Name of petitioner transpired in this case on the basis of confessional statement of co-accused Kshatadhari Yadav. No incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedents. Counsel for State however vehemently opposed the

Patna High Court CR. MISC. No.10831 of 2023(2) dt.15-05-2023 2/2 prayer for bail and submitted that several looted articles were recovered from possession of this petitioner. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
