Earlier the prayer for bail of the petitioner was rejected vide order dated 03.12.2014 passed in Cr. Misc. No. 46525 of 2014, giving liberty to the petitioner to renew his prayer for bail if his trial is not concluded within a period of six months. Learned trial court has reported that out of seven proposed prosecution witnesses, three prosecution witnesses have already been examined and the trial of the petitioner is still pending. The learned trial court has stated that he will try to conclude the trial of the case within next two months. Considering the aforesaid facts and circumstances as well as submissions of the parties, the prayer for bail of the
Patna High Court Cr.Misc. No.28903 of 2015 (3) dt.13-10-2015 2/2 petitioner is again rejected. However, if the N.D.P.S case No.70 of 2014 pending in the court of 3rd Additional Sessions Judge, Motihari is not concluded within two months from today, petitioner may approach the concerned trial court for grant of bail.
