The petitioner has retired from the post of Executive Engineer (Estimating Officer) from the office of the Executive Engineer, Minor Irrigation Department, Arrah, on 31.01.1994. The present writ application has been filed for a direction to the respondents to pay all the consequential benefits pursuant to the time-bound promotion granted to the petitioner vide letter no. 2004, dated 28.07.1992.
Counter affidavits have been filed on behalf of the respondent no. 2 as well as respondent no. 1 and 3 to 7. In the
Patna High Court CWJC No.20752 of 2014(2) dt.05-12-2022 2/2 said counter affidavits, it has been stated that vide letter no. 4286, dated 24.05.2003, the time-bound promotion granted to the petitioner has been cancelled. The petitioner has not challenged the said letter, by which his time-bound promotion was cancelled.
In view of the fact that the time-bound promotion granted to the petitioner has been cancelled, he is not entitled to be given any relief of consequential benefits. In the result, this application is dismissed. (Anil Kumar Sinha, J.) Prabhakar Anand/- U √
