Let the defect(s), if any, be removed within a period of four weeks.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 272, 273, 308/34 and 120(B) of the Indian Penal Code as well as Sections 30(A), 38(A) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

This is the second attempt of the petitioner to seek anticipatory bail as earlier his anticipatory bail application was dismissed by order dated 29.01.2019 in Cr. Misc. No. 3623 of 2019.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that the second

Patna High Court CR. MISC. No.17987 of 2023(2) dt.13-07-2023 2/2 anticipatory bail application on the same ground is not maintainable.

Considering the submission of the learned A.P.P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioner in connection with Nautan P.S. Case No. 194 of 2018 pending in the Court of learned Additional Sessions JudgeII-cum-Special Judge, Excise, Siwan/successor Court. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
