JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 07-04-2015 Heard learned counsel for the petitioner as well as learned APP for the State.

Petitioner along with one Ranjeet was apprehended at wee hour while they were negotiating to sell a stolen vehicle. After their arrest, they made inculpatory confessional statement on the basis of which other vehicles were also seized from Patna in terms of seizure list. Admittedly, petitioner happens to be under custody since 21.09.2013. Furthermore, it is apparent from own disclosure of petitioner under para-3 of the petition that he has got notoriety in his field being accused in two other cases since before excluding the present one and all happen to be related with stealing of vehicles.

Taking into account the conduct of the petitioner, stringent mode of condition is found appropriate in getting his

Patna High Court Cr.Misc. No.51583 of 2014 (3) dt.07-04-2015 criminal activities ceased. That being so, petitioner is directed to deposit cash surety of Rs. 2 lakhs with a condition that further involvement of petitioner will subject to forfeiture of the aforesaid amount.

With the condition aforesaid, petitioner, Saransh Kumar @ Sunil Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Adhoc Additional Sessions Judge-II, Samastipur in Sessions Trial No. 645/2013 arising out of Mufassil(Samastipur) PS case No. 435/2013.

In case, there happens to be no forfeiture of the money, then in that event, after conclusion of the trial, the aforesaid amount will be returned back to the petitioner after due identification.
