03-03-2015 Heard learned counsel for the petitioner and learned Addl. Public Prosecutor.
The petitioner, who is in custody since 30.05.2014 in Bhabua P.S. Case no.231 of 2014 registered for the offence under Sections 25(1-b) a/26 of the Arms Act, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner was falsely implicated in the present case and it was shown that a loaded country made pistol was recovered from the petitioner. He submits that the petitioner has got clean antecedent. This fact has been mentioned in paragraph-3 of the petition.
Keeping in view the nature of accusation as well as period of custody, let the petitioner Anjish Kumar Patel be
Patna High Court Cr.Misc. No.49383 of 2014 (2) dt.03-03-2015 2/2 enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabua in connection with Bhabua P.S. Case no.231 of 2014 on conditions that (i) one of the bailors must be blood relation of the petitioner and (ii) on each and every date during trial, the petitioner shall remain physically present in court. If continuously on two dates the petitioner fails to appear before the court without prior permission of the court, his bail bond shall stand automatically cancelled.
