====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 28-03-2025 Heard Mr. Santosh Kumar, learned counsel appearing on behalf of the petitioner and Mr. Sanjay Kumar Singh, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Bhabhua P.S. Case No. 36 of 2023, registered for the offence punishable under Sections 341, 323, 384, 379, 504 and 506 of the Indian Penal Code.

3. As per the allegation made in the FIR, petitioner along with other accused persons, had assaulted the informant for non fulfillment of demand of extortion.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is innocent and has falsely been implicated in the present case. General and omnibus allegation has been levelled against the petitioner. In absence of

Patna High Court CR. MISC. No.11895 of 2025(2) dt.28-03-2025 2/2 any specific allegation, petitioner cannot be said to have committed crime as has been alleged in the FIR. On these grounds, petitioner seeks to be released on pre-arrest bail.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the nature of allegation, as well as, the criminal antecedents of the petitioner as per the information given in paragraph no. 3 of the bail application, I am not inclined to enlarge the petitioner on pre-arrest bail.

7. Accordingly, the present bail application stands dismissed.
