The petitioner seeks bail in a case under Sections 302 and other sections of the Indian Penal Code.
The petitioner is not named in the F.I.R. Three persons were murdered by the extremists on the allegation that the deceased were the informer of the police. During the course of investigation, some of the witnesses disclosed the name of the petitioner as member of the mob. The petitioner is in jail since 14.02.2013, i.e. for about two years and six months. It is submitted that the petitioner had no knowledge about his implication in the case. Other accused persons have already been acquitted. Considering the fact that the petitioner is in jail for about two years and six months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.49409 of 2014 (4) dt.04-08-2015 2/2 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Adhoc Additional Sessions Judge-I, Aurangabad in Madanpur P.S. Case No. 74 of 1996, corresponding to S. Tr. No. 108 of 2013, subject to the condition that the petitioner shall appear on each and every date during the course of trial. If the petitioner fails to appear on any date without any reasonable reason, the trial court shall cancel the bail bonds of the petitioner.
