The petitioner seeks bail in a case registered for the offence under Section 409 / 420 of the Indian Penal Code. As per the prosecution case, the petitioner is alleged to have not completed the construction work under Sarve Siksha Abhiyan and thus, has embezzled an amount of Rs. 1,71,990 / -. It is submitted on behalf of petitioner that the work has already been completed, through father of the petitioner, and to this effect, Annexure - 2 has been brought on record, which is a letter, issued from the office of Block Education Officer, Adhaura, Kaimur (Bhabhua) regarding completion of aforesaid work. Petitioner is in custody since 21.04.2021. Investigation is complete.

Considering the aforesaid facts and circumstances as well as the fact that petitioner has already got the work completed through his father and his period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - VI, Kaimur at Bhabua in connection with Adhaura P.S.
