In the present writ application, the petitioners have prayed for quashing of notice dated 29.12.2018 issued with the signature of the Anchaladhidari, Babubari (Respondent No.4) in Encroachment case No.12 of 2018-19, whereby and whereunder the petitioners have been directed to appear before him on 12.01.2019 and file their show cause as to why the encroachment made over the land in question may not be removed under the provisions of Bihar Public Land Encroachment Act, 1956.

Annexure 1 under challenge is the notice under Section 3 of the Bihar Public Land Encroachment Act.

Patna High Court CWJC No.2573 of 2019(2) dt.20-02-2019 2/2 Considering the reliefs sought for, the petitioners are directed to file their objection/s under Section 4 of the Act before the Competent Authority within a period of thirty days from today. The Competent Authority i.e. The Respondent No.4 The Anchaladhikari, Babubarhi Anchal, District Madhubani, after giving adequate opportunity to the petitioners of hearing under Section 5 of the Act, shall dispose of the proceeding in accordance with law within a period of three months from the date of filing of such objection/s.

With the aforesaid observation and direction, the present writ application stands disposed of.
