JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Saraiya P.S. Case No. 773 of 2021, registered for the offence punishable punishable under Sections 272, 273/34 of the Indian Penal Code, section 30(a) of the Bihar Prohibition and Excise Act, 2016 and section 20/22 of the Narcotic Drugs and Psychotropic Substances Act. 250 gms. of Ganja has been recovered from possession of co-accused Deepak Kumar Gupta and 60 liters of country made liquor has been recovered from a field. This petitioner was seen fleeing away from the place of recovery. It is submitted that no narcotic substance has been recovered from the possession of this petitioner. Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Court No.-II, Muzaffarpur in connection with Saraiya P.S. Case No. 773 of 2021.
