The petitioners apprehend their arrest in Gogri P.S. case No. 183 of 2014 under Section 379 and other Sections of the Indian Penal Code.

The informant named the petitioners along with other accused persons and alleged that they all, having armed with different weapons, came and forcibly took away pumping set of 10 HP, saw machine, cycle, sewing machine, two Jersy cows, one she goat, rice, wheat and Rs. 55,000/- cash with ornaments on a bullock cart.

It is submitted that elder brother of petitioners filed Gogri P.S. case No. 184 of 2014 against the informant and her

Patna High Court Cr.Misc. No.26876 of 2016 (3) dt.01-09-2016 2/2 husband alleging that informant, Bindu Devi, and her husband, Pramod Yadav, have opened a chit fund company and they cheated the villagers and in order to save their skin the present case has been filed. The story, as disclosed by the informant, itself appears to be a cock and bull story as all the articles were taken on a bullock cart.

Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Brajesh Kumar, the learned Judicial Magistrate, 1st class, Khagaria in Gogri P.S. Case No. 183 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
