The petitioner has prayed for regular bail in a case registered for the offence punishable under section 306 of the Indian Penal Code.
According to FIR, it is a case of abatement of suicide. Allegation against the petitioner is that he abducted the daughter of informant and thereafter he left her due to this reason, the victim/daughter of informant was in stress and committed suicide.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted vide para 6 & 7 of the petition that prior to the instance case, no any case has been lodged against the petitioner regarding abduction
Patna High Court CR. MISC. No.8811 of 2023(3) dt.20-07-2023 2/2 of the informant's daughter. The reason for committing suicide given in FIR is not believable as the informant himself stated that he kept his daughter at the house of Manager Yadav where, she committed suicide. The petitioner has no concern with the alleged occurrence and the death of the informant's daughter is suspicions. Moreover, the petitioner has surrendered before learned Court below on 18.11.2022 and since then, he is languishing in judicial custody.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Yogapatti P.S. Case No. 225 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran.
