JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2015 Heard learned counsels for the petitioners and the State. The petitioners being elder brother, elder brother's wife and younger brother of the husband of the complainant are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323,379 and 498A of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioners that the accusation is not specific against the petitioners rather it is specific against the mother of the husband and the husband of the
Patna High Court Cr.Misc. No.50146 of 2014 (2) dt.27-04-2015 2/2 complainant and the petitioners are separate from the husband of the complainant.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Saharsa in connection with Complaint Case No. 1420 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
