JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-02-2019 The petitioner seeks bail in anticipation of his arrest in connection with Motipur P.S. Case No. 453 of 2018, dated 31.05.2018, instituted for the offences under Sections 147, 148, 149, 341, 447, 448, 323, 504, 427, 395, 354, 354(B) and 436 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case, as per the written report of the informant/Md. Saffiullah, dated 31.05.2018, submitted to the Station House Officer, Motipur Police Station, is to the effect that on 30.05.2018 at 8:00 A.M., while he was at his door, 38 F.I.R. named accused persons and about 200 - 300 unknown persons came and tried to set his house on fire,
Patna High Court Cr.Misc. No.9134 of 2019(2) dt.15-02-2019 2/2 resulting into damage of articles worth Rs. 8 - 10 lacs. It is further alleged that miscreants threatened the informant to leave the village.
It has been submitted on behalf of the petitioner that there is a general and omnibus allegation against the petitioner.
The petitioner does not have criminal antecedents. Considering the aforesaid facts, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Muzaffapur in connection with Motipur P.S. Case No. 453 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
