This is a petition for grant of regular bail in a case under Section 394 of the Indian Penal Code and under Section 27 of the Arms Act.
It is alleged that on 12.05.2015, when the informant after closing his shop and proceeded to his rented house on motorcycle, three miscreants riding on motorcycle came and began to snatch cash. It is further alleged that when the informant protested, one of the miscreants fired from firearms causing injury upon the right hand and right thigh of the informant and subsequently, they took away Rs.4300/- and Nokia mobile and fled away.
Patna High Court Cr.Misc. No.50443 of 2015 (3) dt.09-02-2016 Learned counsel for the petitioner submits that there is nothing against the petitioner, except the confessional statement of the co-accused. It is further submitted that neither any recovery has been made from the possession of the petitioner nor he has been put on T.I.P.
Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 375 of 2015.
