====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 15-05-2018 Heard the learned counsel for the petitioner. This petitioner has filed this petition against the order dated 23.12.2017 by which the learned Execution Munsif allowed the petition of decree holder and directed to depute police officers for execution of decree.
The learned counsel for the petitioner submits that there is dispute with regard to only 4 katha and 4 dhur of land and partition suit is pending between the judgement debtors. It appears that execution case was filed in the year 1981 and since then on one pretext or the other the delivery of possession is being avoided.
I do not find any reason to interfere in the impugned order. Accordingly, this Civil Misc. petition is dismissed being devoid of any merit.
