JUSTICE SATYAVRAT VERMA ORAL ORDER 10-03-2022 Heard learned counsel for the petitioners and Mr. Ram Sevak Choudhary, learned A.P.P. for the State. The petitioners seek bail in connection with Sakra P.S. Case No. 501 of 2021 instituted for the offences under Sections 147, 148, 149, 188, 342, 332, 333, 307, 353, 504 and 506 of the Indian Penal Code read with Section 30(a), of the Bihar Prohibition & Excise Act, 2018 Learned counsel for the petitioners submits that the petitioners are in custody since 12.10.2021 are persons of clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 2.25 liters of liquor from the house of Bali Ram.

No.9352 of 2022(2) dt.10-03-2022 2/2 Learned counsel for the petitioners submits that there was a party going on in the house of Bali Ram where the petitioner is also present and it is alleged that someone informed the police based on which the police came and there was a scuffle between the police and the side of the petitioners leading to injury on both sides, the learned counsel submits it is alleged that the police men were also injured but the injury report shows that the injuries are simple in nature.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioners are in custody since 12.10.2021 and charge-sheet has been submitted in the case and are persons with clean antecedents, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, Muzuffarpur in connection with Sakra P.S. Case No. 501 of 2021.
