JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks bail in connection with Guthani P.S. Case No.162/2019, registered under Sections 420, 465 and 467 of the Indian Penal Code and later on Section 30(a), 38(1) and 41(1) of the Bihar Excise and Prohibition Act 2016 were added. There is recovery of huge quantity of liquor. Submission of learned counsel for the petitioner is that the petitioner is innocent and has not committed any offence rather he has been falsely implicated in this case and he is in custody since 13.10.2019 , having no criminal antecedent and charge sheet has been submitted, as such there is no chance of tampering with the evidence.

In view of the above facts and circumstances, let petitioner be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.7194 of 2020(2) dt.24-02-2020 2/2 Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 2nd -cum-Special Judge (Excise), Siwan, in connection with Guthani P.S. Case No.162/2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
