The petitioner, Balguz Yadav @ Santosh Yadav, is in custody in Singhshwar P.S. Case No. 88 of 2015 corresponding to G.R. Case No. 752 of 2015 under Section 147, 148, 341, 323, 324, 325, 504, 506 and 379 of the Indian Penal Code and 3(1)(X) of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989.

According to the prosecution case, the petitioner along with other 4-5 accused persons came to the informant and demanded fish and when he refused to give, the petitioner along with others took away 4-5 quintals of fish.

No.50669 of 2015 (2) dt.30-01-2016 Learned counsel for the petitioner submitted that the petitioner is in custody since 06.08.2015 and except the allegation that the petitioner took away 4-5 quintals of fish, there is no explanation as to how, the fish was taken by the petitioner and where he took the fish and how the informant weight the fish. Considering the nature of allegation and the custody of the petitioner, I direct that the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount to the satisfaction of the learned C.J.M., Madhepura, in connection with Singhshwar P.S. Case No. 88 of 2015 corresponding to G.R. No. 752 of 2015. (Mungeshwar Sahoo, J) brajesh/- U
