The petitioner seeks bail in connection with Shahpur P.S. Case No. 81/13 registered under Sections 341 and 307 read with 34 of the Indian Penal Code. Subsequently, charge-sheet was submitted under Section 302 of the Indian Penal Code and 27 of the Arms Act.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 22.08.2014 passed in Cr. Misc. No. 31879/14.

It is contended that the petitioner is in custody since 26.06.2013 and there is no substantial progress in the trial of the

Patna High Court Cr.Misc. No.51782 of 2015 (2) dt.04-11-2015 2 / 2 case.

Be that as it may, regard being had to the fact that there is direct and specific allegation against the petitioner that he fired causing injury to the Dilip Rai, as a result of which, he died, I am not inclined to grant bail to the petitioner.
