JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with CBI/ACB Case No. RC0232015A0001/2015 registered for the offence punishable under sections 120B, 420, 467, 468 of the Indian Penal Code and section 13(2) read with 13(i)(d) of the Prevention of Corruption Act.

Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report however he has been implicated in this case during investigation. Petitioner never used any certificate issued by Hindi Sahitya Sammelan Allahabad for getting appointment. Moreover, similarly situated co-accused persons have been granted bail by this Court vide orders dated 07.09.2017, 12.09.2017, 20.09.2017, 13.10.2017, 17.10.2017, 01.11.2017 and 17.11.2017

Patna High Court Cr.Misc. No.54517 of 2017(3) dt.21-12-2017 2/2 passed in Cr. Misc. Nos. 39977 of 2017, 38547 of 2017, 32417 of 2017, 47268 of 2017, 49588 of 2017, 49549 of 2017 and 49364 of 2017 respectively.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, CBI II, Patna in connection with CBI/ACB Case No. RC 0232015A0001/2015 subject to the conditions laid down under section 438(2) Cr.P.C.
