JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 05-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

On account of murder of Fuleshwar Thakur @ Kailu, instant case has been registered against unknown at the instance of father of deceased.

During course of investigation, there happens to be joint statement of the witnesses, such as Paragraph-24 and onward that deceased had hired tractor and had gone to his Sasural along with this petitioner and one Chhotu, as is evident from statement of brother in-law (Sala) of deceased recorded under Paragraph-34 and then thereafter, his dead body was traced out. The occurrence is of the year 2011, and petitioner is under judicial custody since 02.09.2014.

Accordingly, I do not see it a fit case for grant of bail.

Patna High Court Cr.Misc. No.50136 of 2014 (04) dt.05-05-2015 Hence, prayer of petitioner for bail is rejected. The learned lower Court is directed to expedite the trial and will endeavour to conclude the same within nine months. In case, trial is not concluded within the aforesaid stipulated period, then in that event, petitioner will be at liberty to renew his prayer for bail.
