The petitioner has prayed for bail in connection with Yogapatti Nawalpur P.S. Case No. 609 of 2022 registered for the offence punishable under Sections 341, 323, 324, 325, 307, 379, 504 and 506/34 of the Indian Penal Code the thrust of accusation is that petitioner along with other co-accused persons assaulted the informant's father and when the informant came to his rescue, he was also assaulted.
It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in this case. The injury report is not in
Patna High Court CR. MISC. No.8767 of 2023(2) dt.03-05-2023 2/2 consonance with the prosecution version of the case. Charge-sheet has already been submitted. The petitioner is languishing in Judicial custody since 16.11.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period under custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti Nawalpur P.S.
