JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-03-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the respondents. Learned counsel for the petitioner has placed a copy of the letter dated 16.01.2018 which indicates that the service of the petitioner has been confirmed as Routine Clerk with effect from 3.12.1980 and in that view of the matter, he submits that the present writ application has become infructuous. However, as a matter of precaution, he submits that in case respondents resiled from the letter dated 16.1.2018, the petitioner may be granted liberty to assail the same.

In case, petitioner is denied the benefit arising out of

Patna High Court CWJC No.3361 of 2017(3) dt.22-03-2018 2/2 the confirmation vide order dated 16.1.2018, he may be granted liberty to approach the appropriate forum/court if such occasion arises.

With the aforesaid, the stands disposed of as infructuous.
